Packaging regulations

The Packaging Regulations apply to service packaging used in retail to deliver or support goods to end consumers. This includes various types of packaging such as sandwich bags, disposable cups, disposable tableware, pizza boxes, chip trays, etc., as soon as they are filled with goods at the point of sale and delivered to the end consumer.

According to the current statutory packaging regulations, service packaging is “required to be licensed”. This means that whoever fills this packaging must participate in a dual system to ensure that the packaging is taken back by recognized providers in the dual system. Disposal fees are charged for service packaging based on the material type and individual weight, which are paid to the recognized provider in the dual system.

With the latest amendment to the VerpackG, which came into force on July 1, 2022, it is no longer possible to circumvent the registration requirement. Companies that are the first to sell packaged products in retail or online retail to end customers in Germany, companies that deliver to end consumption points such as canteens, kiosks or to-go shops or package accessories, as well as shipping and outer packaging that mainly remains with the end consumer, must register in the LUCID packaging register and, if necessary, pay license fees.

This registration requirement also applies to small and medium-sized businesses that package, import or trade products, including online retailers. Catering establishments and shops that fill service packaging on site and distribute it to end consumers must also register in the packaging register and pay license fees.

Examples of service packaging are cups and cups for hot/cold drinks, disposable tableware for various foods, plates, bowls, trays, menu and snack boxes, bags, wrappers, cone bags, knot bags and carrier bags of all kinds.

The Packaging Ordinance allows you to either carry out the licensing process yourself or transfer responsibility to your suppliers or the packaging manufacturer. If you delegate the licensing to us, we will pay the disposal fees as soon as you are registered in LUCID and give us the order to take over the licensing. It is important to note that this does not apply to online retailers or resellers. Sales packaging must be licensed to comply with legal requirements.
